NLC Hearing: FWSC and CETAG Case Goes to Court for Non-Compliance

The National Labour Commission (NLC) has urged the Colleges of Education Teachers Association of Ghana (CETAG) to end its ongoing strike.

The decision follows a hearing where the NLC informed CETAG that it would be pursuing legal action against the government to enforce its arbitral award orders for the association.

The ruling, which was delivered on Thursday, June 20th, 2024, includes several crucial points.

Firstly, it states that the employer has failed to fully comply with the Arbitral Award orders, which indicates a disregard for the previous decisions made on this matter.

In addition, the NLC ruled that the employer must immediately implement the Arbitral Awards, along with the staff audit report, in full.

Failure to do so was deemed a breach of the employer’s obligations. To enforce this ruling, the Commission revealed it has taken the employer to the High Court, where they will be compelled to comply.

The court appearance has been scheduled for Wednesday, June 26th, 2024, to determine the outcome of the case.

Furthermore, on Thursday, June 27th, 2024, CETAG and the employer will appear before the Commission again.

During this hearing, the employer will be required to present evidence of their compliance with all outstanding Arbitral Awards.

Meanwhile, CETAG has been urged to call off their ongoing strike action.

In light of these recent developments, CETAG has been advised to hold a virtual Council meeting on Friday, June 21st, 2024, at 2 p.m.

This meeting will provide an opportunity for them to discuss the updates and plan the way forward, as to whether they will call off the strike or not.
